Some states require residents to pay taxes on their earned income, which means they must file a tax return. States can choose from three different filing systems: joint, combined, or a version of the two. Like many other states, Maryland opts for a joint system, which is similar to the federal government in that it assesses taxes to a married couple’s income as a single, combined entity.

Same-sex married couples are taxed the same as opposite-sex couples in Maryland, which starts with the federal adjusted gross income. Though the state uses the same tax base, there are some differences between the federal and state systems, including exemptions and deductions.

Exemptions

Some income sources, regardless of where they originated are excluded from the tax base, including:

  • U.S. Government bond interest
  • Pension amounts up to $27,800 from military, public, civil service, or private plans for those over 65 years old.
  • CZE and active duty military pay (up to $15,000 in active duty military pay for service outside the country, provided military income is less than $30,000.
  • Social Security benefits
  • Disability income for firefighters and police officers injured on the job
  • Some artists’ contributions and income from artists in arts and entertainment jobs
  • $3,500 in income for volunteer police officers, police, rescue, Coast Guard and other emergency personnel.

If you make contributions to a Maryland retirement plan or pension, you must include it in income, along with half of all taxable preference items. If Maryland provides a tax credit for certain federal deductions, it must be included in income.

Deductions

Maryland offers a standard deduction that is 15% of the state AGI with the following thresholds:

  • Married, Joint and Head of Household: Min. $3,000/Max. $4,000
  • Remaining Filing statuses: Min. $1,500/Max. $2,000

High-income taxpayers may be limited by certain thresholds placed on state-level deductions. State and local taxes aren’t deductible, though the following expenses can be:

  • Child and dependent care expenses
  • Adoption expenses
  • Contributions and earnings on a prepaid tuition contract
  • Using a vehicle for charitable purposes
  • Solar energy grant awards
  • Unearned income by a dependent included in a parent's AGI
  • Interest on Build America bonds
