California assesses state income tax over nine different brackets with the rate of taxation that varies between 1% and 12.30%. Taxpayers in the Golden State who file using single or married filing separately status are subject to the following rates depending on income:

  • 1% on the first $7,582 of taxable income
  • 2% on taxable income between $7583 and $17,976
  • 4% on taxable income between $17,977 and $28,371
  • 6% on taxable income between $28,372 and $39,384
  • 8% on taxable income between $39,385 and $49,774
  • 9.30% on taxable income between $49,775 and $254,250
  • 10.30% on taxable income between $254,251 and $305,100
  • 11.30% on taxable income between $305,101 and $508,500
  • 12.30% on income of $508,501 and higher

California taxpayers with taxable income of one million dollars or more are subject to an additional 1% surcharge as per the Mental Health Services Tax. Because of this, it can be interpreted that California's highest tax bracket is actually 13.30%.

Tax rates stay the same for married couples who file jointly though that income thresholds double. Example: a couple who is married and files one return would be taxed at 8% if their income was $78,770.

Californians can use form 540EZ, 540A (short form), form 540 (long form), or form 540-ADS to file their state income tax. These forms are typically due on April 15 as long as it's not a holiday or weekend, in which case it would be due on the next day of business.

Residency

There are two factors to determining resident status for the state of California. They are:

  1. You are present in the state physically and your reason is neither temporary nor transitory.
  2. You are temporarily residing in another state, but your permanent residence is in California.

If you intend to reside permanently within the state, and it is the place that you establish your home for yourself and your family you are considered a resident of California. During periods of temporary absence, it is the place in which you intend to return.

Although all sources of income are taxed regardless of where they were earned, taxpayers in the state of California may qualify to claim a credit for any income that was double tax.
